Introduction
These Terms and Conditions (“Terms”) govern all purchases made through the Gardening on Country website (www.gardeningoncountry.com) (“Website”).
By accessing or purchasing from our Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy, Refund Policy, and Disclaimer, which together form the full agreement between you and Gardening on Country (“we”, “us”, “our”).

1. E-Commerce and Orders
We take great care to ensure all product listings, descriptions, and prices are accurate. However, from time to time, errors may occur (for example, pricing or stock availability issues).
When you place an order through our Website, it constitutes an offer to purchase. A contract is formed only when your order is processed and you receive an order confirmation.
If we identify an error (for example, incorrect pricing or unavailable stock), we reserve the right to cancel or amend your order. If your order cannot be fulfilled, you will receive a full refund as soon as practicable.
2. Payment
All prices are listed in Australian Dollars (AUD) and include GST where applicable.
Payment is required at the time of purchase and before dispatch. We currently accept credit card, PayPal and Afterpay payments.
By completing payment, you acknowledge and agree to any terms of third-party payment providers (such as PayPal). We are not responsible for issues, delays, or losses caused by these external payment services.
If your payment fails, is reversed, or declined, you remain responsible for the full amount and any fees or charges we incur as a result. We may suspend or cancel any unpaid order until full payment is received.
3. Shipping and Delivery
We currently ship orders within Australia only.
Orders are generally processed within 48 hours of cleared payment.
a) Postage Rates
Postage and delivery costs are calculated at checkout. If an error in calculation occurs, we’ll contact you to discuss available options before dispatch.
b) Delivery Timeframes
Delivery times vary by location and are dependent on the courier service. We’ll provide an estimated timeframe at checkout and a tracking code once your order is shipped.
c) Delivery Address
Please ensure your delivery address is accurate. We are not responsible for delays, losses, or failed deliveries due to incorrect address details.
If an order is returned to us because of incorrect information, you may be required to pay additional postage to resend it.
d) Lost or Damaged Parcels
If your order is lost or damaged in transit, please contact us promptly. We will investigate with our delivery provider, but our liability is limited to the amount of compensation we can recover from the courier, unless required otherwise by law.
e) Risk
Risk in the goods passes to you upon delivery to your nominated address or upon being left in a safe place (if authorised). If you’ve given authority to leave the order unattended, the order is deemed delivered once left at your address.

We’re not liable for delays or failures caused by circumstances beyond our control — such as natural disasters, strikes, supply chain issues, pandemics, or courier disruptions.
If such an event occurs, we’ll keep you informed and may delay, modify, or cancel your order if necessary. If we cancel your order, a full refund will be provided.
5. Advice and Information
Any advice or information provided on our Website or by our team is given in good faith and intended as general information only. It should not replace professional, horticultural, or medical advice.
We do not accept liability for loss or damage resulting from reliance on information provided unless required by law.
6. Australian Consumer Law (ACL)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth).
You are entitled to:

7. Refunds and Returns

We’ll work with you to arrange a suitable remedy — such as a replacement, refund, or exchange — in line with the Australian Consumer Law and our Refund Policy.

No content may be reproduced, modified, or distributed without our written consent.
9. Dispute Resolution
If you are unhappy with your product or experience, please contact us first at hello@gardeningoncountry.com so we can resolve the issue quickly and fairly.
If we’re unable to reach a resolution within 30 days, both parties agree to participate in mediation in Victoria, Australia, sharing costs equally.
No court action may commence until this process has been attempted (unless urgent injunctive relief is required).
10. Variation of Terms
We may update these Terms at any time by posting the revised version on our Website.
Changes take effect immediately upon posting. We encourage you to review this page periodically.
11. Severability
If any part of these Terms is found invalid or unenforceable, the remaining parts remain in full effect.
12. Termination
We may terminate this agreement at any time with notice. Upon termination, we’ll refund any amounts paid for undelivered goods.
All disclaimers and limitations of liability survive termination.
13. Jurisdiction
These Terms are governed by the laws of Victoria, Australia.
In the event of a dispute, both parties agree to the exclusive jurisdiction of the courts of Victoria.
